Muzzle Awards follow-up: Two victories for free speech

awardAmong the New England Muzzle Award recipients I recognized last month at WGBHNews.org were Massachusetts Attorney General Maura Healey, for backing a ridiculous 70-year-old state law that banned political lying, and New Hampshire State Rep. Timothy Horrigan, a leader in the effort to outlaw the scourge of so-called ballot selfies.

This month, the courts agreed on both fronts.

According to Zack Huffman of Courthouse News Service, the Massachusetts Supreme Judicial Court struck down the anti-lying statute, with Justice Robert Cordy writing:

We conclude that [the statute] cannot be limited to the criminalization of fraudulent or defamatory speech, is neither necessary nor narrowly tailored to advancing the commonwealth’s interest in fair and free elections, and chills the very exchange of ideas that gives meaning to our electoral system.

It is now safe for the presidential candidates to campaign in Massachusetts.

In New Hampshire, U.S. District Judge Paul Barbadoro ruled that the ban on posting photos of a marked ballot could not be justified even though it was supposedly designed to eliminate bribery, with the selfie providing the proof needed that the person taking the bribe had voted as instructed.

The problem, Barbadoro noted, was that such fraud had not actually taken place in at least the past 100 years. In addition, Barbadoro ruled that the law “deprives voters of one of their most powerful means of letting the world know how they voted,” according to an account of the decision by Jeremy Blackman of the Concord Monitor.

The moral of these stories: Do not mess with the Muzzles.

Globe seeks buyouts as it extends digital push

The Boston Globe is once again seeking buyouts, even as it ramps up to launch its life-sciences vertical, Stat, later this year. Editor Brian McGrory lays out the rationale in a memo to the staff, and warns that layoffs may follow if the unspecified goal isn’t reached. (Romenesko beat me, as I was on the road most of Wednesday.)

There’s a lot to chew over here, but let me make one observation. McGrory writes:

We’re proposing a new job category of “multiplatform editor,” someone who can copy edit, post to the web, and design web pages, morning through night. Some editors and producers will roll into that category quickly, but we expect all copy editors and layout/makeup/slot editors to take on significant web responsibilities in the very near future.

No one without these skills should have been hired after, oh, let’s say 2003. Yet here we are in 2015, and the Globe — as well as the newspaper business in general — are still wrestling with these issues. Though the copy-editing is bound to deteriorate to some extent, as McGrory himself acknowledges (“most stories will get fewer reads”), I see this mainly as a sign of how difficult it is to turn around a battleship such as a major metropolitan newspaper.

Dear colleagues,

In the worst kept secrets category, the Globe is launching another buyout program next week, this one specific to the newsroom. Similar to last year’s, we’ll use it as an opportunity to direct more resources to digital, a vital undertaking. Different than last year, it will also help us cut costs as we continue our transformation into a predominantly digital, subscriber-based news operation that will thrive for many years to come. If we fail in our savings goal through buyouts, we’ll be faced with the difficult prospect of layoffs in September.

Everyone in the newsroom will receive a buyout letter as early as next week. There’ll be nothing terribly fancy about the math. It’s two weeks for every year of service – the same as severance. I think the following line is on the save/get key of every editor in America: This may be the last buyout we offer. At some point, good or bad, that statement will be true.

Over the coming weeks, the plan is to focus change, in part, on the production end of the newsroom, including our copy editing, page layout, and web production functions. We’re proposing a new job category of “multiplatform editor,” someone who can copy edit, post to the web, and design web pages, morning through night. Some editors and producers will roll into that category quickly, but we expect all copy editors and layout/makeup/slot editors to take on significant web responsibilities in the very near future.

Our copy and layout desks have served this organization exceptionally well over many, many years. Every reporter and line editor at the Globe can point at specific instances where eagle-eyed desk editors have spared us from unspeakable embarrassment. Night after night, the desk improves our copy and makes the paper gleam. The issue, though, is that we can’t afford the kind of print-centric copy editing operation that we have maintained for too long. We can’t afford it financially, and we can’t afford what it does to our larger enterprise, which is to implicitly put an undue focus on print when we’re otherwise making such significant strides emphasizing digital.

So what does it mean, practically? Details are being worked out, but it will mean a streamlined copy editing operation. It will mean that most stories will get fewer reads, placing more responsibility on reporters and line editors to make sure they’re in good shape. It means that rather than a copy desk, we will have a multiplatform production desk where stories are copy edited, posted on line, perhaps placed in the social stream, and later set on pages for print. The Sports desk is already doing this. Now we need to bring it to the Universal and Features desks.

Since we spoke about our digital ambitions in April [see this], progress has been steady. We’re up about 15 percent in page views from this time last year, when we had a record-breaking summer. We’re posting far more stories far earlier in the day, including hefty enterprise stories slated for the next day’s print front page. Our digital first reporters have made a deep and meaningful mark in terms of tone, speed, and quality. Our newsletters in sports and politics are uncommonly well done and popular. And in truth, ever more reporters and editors are seeing themselves as digital first, which is exactly as it should be. This talented newsroom needs to focus even more on the journalism, not the platform. Readers will consume us in whatever form they choose.

But we need to do more. We need to be crisper in our execution of stories. We need to continue to hire more reporters and graphic artists who are native to the web. We need to go department by department, looking to redirect our talent and focus to digital – meaning that jobs will likely change in the coming weeks and months. We need to further break the long-held rhythms of a print operation. We need to be more thoughtful and structured in how we roll out our enterprise, our most widely read work. On that last point, [BostonGlobe.com editor] Jason Tuohey has developed a release schedule that will help guide us every day, dictating when enterprise is put online and in the social stream to maximize readership. Jason and [managing editor for digital] David Skok will be meeting soon with department heads and web editors to elaborate.

Amid this transition, the realities of the industry dictate that more cuts be made, and we’re looking around the newsroom and across the company, always with an eye to protect our journalism. We’ve frozen most open positions, though not all, throughout the building. There have already been layoffs in other parts of the building, and those will continue. We’re looking at some modest page reductions in the newsroom. We’re cutting back on freelance spending, which the page reductions will make easier.

All of this is an effort not only to live within our means, but to create a sustainable news organization, one that depends far more on digital subscriptions, where revenue is rising, than on print advertising, where our industry faces inexorable declines. In this effort, we are well positioned for success. The company has no debt. We have no pension obligations, which were left with the New York Times. We don’t have an owner looking to ratchet up margins. We have an innovative spirit. We have a deep, deep reservoir of talent and ambition. We’re simply looking to turn a modest profit, which the ownership will then invest in the enterprise.

On so many fronts here, we’ve already seen significant progress. Print circulation has been largely stable, with nominal declines. In terms of digital circulation, we have more subscribers than any other news organization outside of New York – and those readers are paying more money for a subscription than any other place besides the Times or Wall Street Journal. The site reads and looks terrific, with an increasing emphasis on web-only graphics and stories, work that thrives in the moment and is geared to our online readership.

For that matter, your work in the paper has been equally compelling. In fact, many of our investments have paid off, not in jackpot fashion, but in upward movement. The standalone Business section has been a major hit with readers and advertisers. The premium Sunday magazines are leading to a major revenue increase from last year. Some big-ticket advertisers are pushing to bring Capital back to a freestanding section in September, which we’ll likely do. Sunday Travel and Address are two absurdly readable sections that have succeeded in stemming declines or are seeing category increases. Sunday Arts is a source of weekly pride and reader enjoyment. For the first time, regional and national brands are partnering with us in novel, cross-platform advertising campaigns that include event sponsorships.

And then there’s the daily journalism – accountability reporting, narrative writing, elaborate beat reporting, stories that inform and entertain. We have set the agenda with our even-handed yet penetrating coverage of the Olympics bid, from birth to this week’s death. Nobody’s been better at chronicling the downfall of the Red Sox and the meaning of Deflategate. Nobody has more accessible and insightful critics. Our DC bureau has reported and written like a dream, from Vienna to Iowa. Our Tsarnaev trial coverage caught the attention of the world. Exceptional online presentations and graphics, from Pedro Martinez to the impact of global warming on the Arctic Ocean, are becoming wonderfully commonplace. The list could go on. Which is to say, again, the business model for journalism may be broken, but the journalism, specifically your journalism, is not.

Change is exciting, but the nasty sibling of change is uncertainty, and that can be scary as hell. Please remember that this newsroom has accomplished extraordinary journalism in the face of enormous uncertainty for many years running. We’ve been threatened with closure. We’ve been twice put up for sale – before fortunately landing with a deeply committed owner. We, like everyone else, have seen significant staff reductions. And through it all, you’ve created cutting edge and thriving websites. You’ve won Pulitzer Prizes and every other award under the sun. You produce one of the most thoughtful and provocative daily reports in the nation. The next couple of months will carry another dose of pain, again in the departure of prized colleagues. But please don’t doubt that we’ll emerge as a healthy and forward-looking enterprise, primed for continued excellence.

Why the Olympics defeat is the Market Basket saga of 2015

The defeat of the Boston Olympics bid was this summer’s Market Basket story — a feel-good saga about ordinary people triumphing over the moneyed interests. Boston Globe columnist Joan Vennochi calls the opponents “heroes.”

Of course, there were a lot of good people involved in Boston 2024, and they don’t deserve to be cast as the bad guys. But it was a great moment on Monday when Boston Mayor Marty Walsh stepped to the podium to say that he wasn’t willing to put taxpayers at risk, thus bringing this contentious chapter to a close.

Some of us opposed to the Olympics began cautiously celebrating on July 17, when The Boston Globe ran a story by its veteran Olympics reporter, John Powers, that made it sound like Walsh, Gov. Charlie Baker and the U.S. Olympic Committee were all trying to send a signal that it was over. In particular, Powers noted that the political establishment is always a driving force behind successful Olympic bids, and that was entirely lacking with Boston 2024.

There’s already plenty of discussion about what went wrong with the proposal. Personally, I don’t think anything went wrong. We didn’t want the Olympics, and nobody asked us. A better job of salesmanship wasn’t going to matter. As Michael Jonas writes in CommonWealth Magazine:

Far from being small-minded killjoys, Bostonians proved to be a pretty forward-looking, sophisticated lot. We asked a lot of questions, didn’t settle for half-baked answers, and weren’t overly wowed by the shiny objects the US Olympic Committee dangled in front of us.

As for the public improvements we will supposedly lose now that the Olympics won’t be disrupting our lives for the next nine years, there isn’t a single unmet need — be it transportation improvements, affordable housing or the redevelopment of blighted areas — that can’t be met better without the games. Former WCVB-TV (Channel 5) editorial director Marjorie Arons-Barron writes:

If Boston 2024 boosters are really serious about a long-term vision and strategy for greater Boston, why not join forces with Mayor Walsh in his nascent Boston 2030 planning? If this wasn’t just marketing palaver, they could put their resources (including their unspent budget) and talent together with others in the city (including the No Boston Olympic supporters) to develop and implement a smart and integrated plan to upgrade housing, roads and bridges, public transit, education, creating jobs and more so that greater Boston can express its aspirations in a practical and achievable blueprint that can transform the city and meet the needs of all its people. That would be a gold-medal-winning performance.

Kudos to everyone on a tremendous victory.

Cities and towns seek to derail public-records reform

A serious attempt to reform the state’s broken public-records law — the shortcomings of which I described recently in the WGBH News Muzzle Awards — is on the verge of being derailed by the Massachusetts Municipal Association (MMA), according to advocates.

On Friday came word that the state Legislature was likely to pass the long-awaited reform bill, House 2772, according to The Boston Globe and State House News Service. The bill, though not perfect, includes key provisions to hit noncompliant government agencies with lawyers’ fees and to limit how much those agencies can charge for complying with public-records requests.

Now comes word that the municipal association, a lobbying group for the state’s cities and towns, is working to prevent final passage. Here is a statement sent out by the MMA in which the bill is denounced as an “unfunded mandate” that could be used to “harass” local officials.

The following is an email sent to me by Bob Ambrogi, executive director of the Massachusetts Newspaper Publishers Association.

Hi Folks,

It is do or die time for MassFOIA, because our public records bill, which was on the move, is now under aggressive attack.

As of yesterday, the plan was for a House vote on our public records bill next Weds, with a Senate vote the following week. Now, the MMA is fighting back with everything they have [a reference to the document linked above] and we need to do the same or the bill may be dead.  In fact, it appears the House has cancelled their formal session for next week so our reform efforts are in mortal danger. If they kill the bill now, it will be all the more difficult to revive.

So, please:

1) Write to your members to get them to call or email their legislators. I’ve attached an email that Pam wrote to Common Cause members this morning. [Note: I have not included the attachment.]

2) Stay tuned as we develop materials over the weekend and early next week that you may need to sign onto — such as a coalition letter. We will need a quick turn around.

3) Keep your eyes open for updated talking points over the weekend.

Why newspaper apps still matter

Remember when the iPad was going to save the news business? How did that work out? But if the redemptive qualities of tablets turned out to be overblown, they are nevertheless a compelling platform for consuming all kinds of text and multimedia material, including news.

This morning I spent way too much time with The Washington Post’s new iOS app, which is detailed at the Nieman Journalism lab by Shan Wang. It is beautiful, with large pictures and highly readable type. I was already a fan of what the Post is now calling “Washington Post Classic.” But this is better.

So do I have a complaint? Of course. The Classic app is more complete; it includes local news (no, I have no connection to the Washington area, but it’s nice to be able to look in on occasion), whereas the new app is aimed at “national, international audiences.”

And both apps rely more on viral content than the print edition, a sluggish version of which is included in Classic.

Quibbles aside, this is a great step forward, and evidence of the breakthroughs that are possible with technology billionaire Jeff Bezos in charge. In fact, the new app is a version of one that was released last fall for the Amazon Fire. So it’s also heartening to see that Bezos isn’t leveraging his ownership of the Post entirely to Amazon’s advantage.

Another paper with a billionaire owner has taken a different approach. Several months ago John Henry’s Boston Globe mothballed its iOS replica edition — that is, an edition based on images of the print paper — and replaced it with an app that is still print-centric but faster and easier to use. It was developed by miLibris, a French company.

The first few iterations were buggy, but it’s gotten better. In general, I’m not a fan of looking at the print edition on a screen. But I find that the Globe’s website is slow enough on my aging iPad that I often turn to the app just so I can zoom through the paper more quickly, even if I’m missing out on video and other Web extras.

One big bug that still needs to be squashed: When you try to tweet a story, the app generates a link that goes not to the story but, rather, to the Apple Store so that you can download the app. Which, of course, you already have.

Finally, it’s worth noting that the Boston Herald has a pretty nice iOS app, developed by DoApp of Minneapolis. It’s based on tiles, so it’s fast and simple to use. It’s so superior to the Herald’s creaky website that I wish there were a Web version.

Do apps for individual news organizations even matter? We are, after all, entering the age of Apple News and Facebook Instant Articles.

My provisional answer is that the news organizations should both experiment with and push back against the drive toward distributed content. It’s fine for news executives to cut deals with the likes of Tim Cook and Mark Zuckerberg. But it would be a huge mistake if, in the process, they let their own platforms wither.

The Globe’s Clegg gets a vote of confidence from John Henry

Ellen Clegg has been named editorial-page editor of The Boston Globe, less than a year after she was brought in to serve on an interim basis following the departure of Peter Canellos, now a top editor at Politico.

The move, announced by publisher and owner John Henry, strikes me as overdue. You don’t let an interim editor completely remake the pages, as Clegg was recently allowed to do. In an email to the staff obtained by Media Nation, Henry wrote:

When Ellen Clegg graciously accepted the challenge to take on the role of Editor, Editorial Page on an interim basis, she did so with enthusiasm, resolve, and a commitment to bring a fresh perspective and new voices to the section. I truly believe her leadership has brought vitality and relevance to the section, reflective of the improvements I’m seeing throughout the organization. From Day One, Ellen has acted as if the term “interim” was just a word, not her destiny. So it is my great pleasure to announce that as of Monday, Ellen Clegg is Editor, Editorial Page of The Boston Globe. No ifs, ands, buts, nor interims about it.

Thanks, Ellen. Keep up the great work.

Clegg has a closer relationship with Henry than Canellos did, having previously served as the top spokeswoman for the Globe — and, thus, for Henry. Before that she was a longtime Globe journalist, serving in a variety of editing positions. Among other things, she is the author of the award-winning book “ChemoBrain: How Cancer Therapies Can Affect Your Mind” (Prometheus Books, 2009). You can read more about her background here.

Today’s editorial pages — simply labeled “Opinion” since the redesign — are characteristic of Clegg’s graphics-intensive vision.

To my eye, the most interesting piece today is a short commentary by editorial writer Marcela García on a dangerous proposal to make it easier for Massachusetts families to opt out of mandatory vaccines. It’s accompanied by a large, data-heavy map. Online, you can find a chart showing the opt-out rate at every public school in the state. It should fuel follow-ups by community news organizations across Massachusetts.

Clegg is also soliciting short opinionated videos that will run in a new section to be called “Opinion Reel.”

I’ve heard laments from several Globe readers — older, but smart and engaged — who think the redesign represents a dumbing-down of the paper’s traditional editorial and op-ed pages. For Clegg, it’s going to prove to be a balancing act in trying to attract new readers while not alienating her most dedicated audience. One thing that would help: doing a better job of alerting print readers that there’s additional content online.

As editorial-page editor, Clegg is a masthead equal with editor Brian McGrory. Both report directly to Henry. It’s taken a couple of years, but it looks Henry’s team is finally in place.

Presenting the 18th annual New England Muzzle Awards

Please have a look at the 18th edition of the New England Muzzle Awards — launched in 1998 at the late, great Boston Phoenix and now hosted exclusively by WGBHNews.org. The Campus Muzzles, as always, are helmed by civil-liberties lawyer Harvey Silverglate.

Why Brian Williams’ return will be a disaster for NBC News

I really don’t understand why the folks at NBC News think serial fabricator Brian Williams can be rehabilitated. CNN’s Brian Stelter reports that Williams’ second act could be announced as early as today.

Yes, Williams is receiving a significant demotion — he’s supposedly being shipped off to MSNBC, which had a nice run as the liberal alternative to Fox News before plunging into unwatched obscurity the past couple of years. But given that NBC News major domo Andrew Lack is reportedly seeking to revive MSNBC with an injection of actual news, how can a guy who set fire to his own credibility be part of that? As Jay Rosen put it on Twitter: “NBC has to explain how he’s lost the credibility to anchor the nightly news but still has the cred to do the news on MSNBC.”

Remember, we’re not just talking about Williams’ lies regarding his helicopter ride in Iraq. There have been multiple instances in which he overstated the facts or just made stuff up. The New York Times reports:

Almost immediately after the controversy erupted, NBC opened an investigation into Mr. Williams, led by Richard Esposito, the senior executive producer for investigations. Over the last several months it uncovered 10 to 12 instances in which he was thought to have exaggerated or fabricated accounts of his reporting, according to people familiar with the inquiry.

And just wait until one of Williams’ anonymous enemies posts a “closely held” clip reel on YouTube that is said to document his worst moments. The Washington Post has this to say:

The video, produced by the team of NBC journalists assigned to review Williams’s statements in media appearances, makes a vivid case against the anchor, according to people familiar with it, isolating a number of questionable statements Williams has made.

Professional cynic Michael Wolff told old friend Mark Leibovich recently that NBC never should have abandoned Williams in the first place. Rather, he said, the network’s executives should have done their best Roger Ailes imitation and defended him as aggressively as Fox News has defended its own business interests.

But this is stupidity masquerading as sagacity. NBC News is not the Fox News Channel. Fox’s product is right-wing talk. NBC News’ purported product is news, served up truthfully. In that market, Williams’ value plunged to zero or close to it within days of his exposure last winter. (The next person who says he would rather see Williams back in the anchor chair rather than Lester Holt will be the first.) I suspect Wolff knows that, but the man does enjoy being provocative.

As for Williams, he needs to leave journalism. And it’s not up to NBC to help him figure out how.

On naming names: Looking back at the Annie Le case

Authorities have arrested and are preparing to charge the Rhode Island suspect in the alleged terrorist plot that ended in the shooting death of a Boston man last week. News organizations that had been withholding his name are now identifying him. The Boston Globe, for instance, reports that he is Nicholas Rovinski, 24, of Warwick, Rhode Island.

As I wrote last week for WGBH News, identifying a “person of interest” who has not been charged — and who may not be charged — is an ethically dubious practice. My views are informed by what I learned in researching my book “The Wired City.” Among the stories I reported on was the New Haven Independent’s decision not to name the likely suspect in the murder of a Yale graduate student until after he had been formally charged. Independent editor Paul Bass spoke with my Northeastern ethics students about the case in a conference call earlier this week.

What follows is an excerpt from “The Wired City,” taken from a longer excerpt published by the Nieman Journalism Lab.

On Monday, Sept. 14, 2009, six days after Annie Le had been reported missing, the Independent became the first to reveal that police had identified a 24-year-old laboratory technician who had worked with Le as a “person of interest.” The New Haven Register’s website followed shortly thereafter. And so began one of the more curious side stories of the Annie Le case.

As law enforcement officials continued with their investigation on Tuesday, neither the Independent nor the Register released the name of Le’s coworker. On Tuesday night, though, the police department held a news conference and announced that the “person of interest” was Raymond Clark, whose name was included in a press release. Because the news conference was covered live by a number of television stations, Clark’s identity immediately became public. On Wednesday, the Register named Clark and interviewed people who knew him. “I’m in total shock,” an unidentified high school classmate was quoted as saying. “He was the nicest kid — very quiet, but everyone liked him. I can’t believe he could do this. I’m sick to my stomach.” But the Independent continued to withhold Clark’s name.

The Independent’s managing editor, Melissa Bailey, was at the news conference too. She took notes and shot some video of New Haven Police Chief James Lewis speaking to reporters. But neither her story nor her video used Clark’s name. Bailey wrote, somewhat cryptically, “Police named the target of the search, calling him a ‘person of interest.’” Nor did the Independent identify Clark on Wednesday — and not even in a story posted early on Thursday morning reporting that police had staked out a motel where Clark was staying the night before, although it did link to a Register story that identified Clark in its lead paragraph. It wasn’t until later on Thursday morning that the Independent finally named Raymond Clark as the person police believed had murdered Annie Le. The reason: by then Clark had been arrested and charged, and was being taken into court for a formal arraignment.

The Independent’s refusal to name Clark until he had been formally charged was an admirable exercise in journalistic restraint. The decision derived in part from Bass’s institutional memory. In 1998, police had mistakenly identified a Yale professor as a “person of interest” in the murder of a student named Suzanne Jovin. No evidence against the professor was ever made public, and the murder was never solved. (In 2013, Yale and the city of New Haven announced a settlement with that wrongly accused professor.) Essentially, though, this restraint was a statement of Bass’s sense of how a news organization ought to serve the community

Judging by comments posted to the Independent, many readers appreciated Bass’s decision. “Thank you for the good sense to not publish his name at this time,” wrote “asdf” on Tuesday evening, after Clark’s name had begun to leak out but before the police had named him. The commenter added: “I really don’t understand what there is to gain by releasing his name — if you don’t have enough evidence to arrest him, then you don’t have enough evidence to smear him in the media.” Then there was this, from “LOOLY,” posted on Wednesday morning, after Clark’s name had been widely reported: “It should really be very simple. Unless he is being charged his name should not be used.”

Bass also had to make several other difficult decisions about identifying people connected to the Annie Le story. On Sept. 14, as Clark’s name was leaking out, the media converged on his apartment in Middletown, northeast of New Haven. Christine Stuart, who runs the political website CT News Junkie and contributes to the Independent, noticed the name of a woman along with that of Raymond Clark. She passed it along, and Melissa Bailey started plugging it into various social-networking sites. It didn’t take long before she found a public MySpace page for the woman, who turned out to be Clark’s 23-year-old fiancée. Bailey captured a screen image before the page could be taken down — which it soon was.

Bailey wrote a story that began, “The target in the slaying of Yale graduate student Annie Le had something in common with the victim — he, too, was engaged.” And she quoted the young woman as writing of Clark: “He has a big heart and tries to see the best in people ALL THE TIME! even when everyone else is telling him that the person is a psycho or that the person can’t be trusted. he thinks everyone deserves a second chance.” The woman’s name and photograph wound up being published by other news outlets, but it never appeared in the Independent.

That was not the Independent’s only social-networking scoop. In nearby Branford, Marcia Chambers of the Branford Eagle, a community news site that is affiliated with the Independent, was working her sources. Somehow she obtained a 2003 police report about an ex-girlfriend of Raymond Clark who claimed he had forced her to have sex when they were both students at Branford High School. As a condition of receiving the report, Chambers promised not to publish it until after an arrest had been made. But that didn’t mean there were not other uses to which the report could be put. Bailey typed the woman’s name into Facebook, discovered that she had an account, and friended her, letting her know she was a reporter covering the murder. After Clark’s arrest, Bailey and Chambers wrote a story without using the woman’s name. “I can’t believe this is true,” they quoted the woman as writing on her Facebook page. “I feel like im 16 all over again. Its jsut bringing back everything.”

The revelation that the Independent had the police report created a media stampede, Bailey said later. “People were calling us, begging us for this police report,” she told a researcher for Columbia University. “The New York Times came in and practically tried to arm-wrestle Paul.” The Independent withheld the fiancée’s name, a decision Bailey wrote that she had no misgivings about even though the woman later appeared on network television and identified herself.

By declining to name Raymond Clark until he had actually been charged with a crime, and by withholding the identities of the two women, Paul Bass had made a statement about what kind of news organization he wanted the Independent to be and what kind of journalism his community could expect from the site. Protecting the two women at a time when only the Independent knew who they were was the more straightforward of the two decisions. Any news executive who cares about journalistic ethics — or, for that matter, basic human decency — might have made the same call. But keeping Clark’s name off the site even after the New Haven police had put it in a press release, and even after the police chief had freely discussed it at a news conference — well, that was an extraordinary decision. Many journalists would argue that a news organization has an obligation to report the name of someone who might soon be charged with murder when the police have very publicly placed that name on the record. But Bass clearly has a different way of looking at such matters.

Weeks later, in a conversation at his office, Bass wondered if he had done the right thing while simultaneously defending his decision. “I still believe it’s a complicated question. I still believe we could definitely be wrong,” he said. Yet, as he continued, he didn’t sound like someone who thought he might be wrong, even as I suggested to him that his decision to withhold Clark’s name could be seen as something of an exercise in futility. “I’m in no way moving toward the idea that we should have run the name. I see no reason for putting the name out sooner. Nothing served,” he said. “I agree with you that it was futile. The name was out there. But we are still a news organization with standards.”

Those standards, I came to realize, are rooted not just in Bass’s view of journalism but in his sense of place, and even in his spiritual beliefs. The Independent is a news site, but it’s not just a news site. It is also a gathering place, a forum for civil discussion of local issues, and a spark for civic engagement. It is a mixture that reflects Bass’s interests: a multifaceted approach to community journalism — to community and journalism — that has been visible in his life and work from the time he began writing about New Haven.

‘Wife bonus’ story called into doubt. Shocking, eh?

CG-UOQ3XAAAb4wpI am shocked, shocked to learn that the “wife bonus” story has been called into question.

Last month I shared with my ethics class an opinion piece that appeared in The New York Times claiming, among other things, that some rich women on Manhattan’s Upper East Side were paid “wife bonuses” by their husbands based on “how well she managed the home budget, whether the kids got into a ‘good’ school — the same way their husbands were rewarded at investment banks.”

The article, by a “social researcher” who goes by the name Wednesday Martin, was based on her forthcoming book, “Primates of New York.”

Martin’s Times piece was, shall we say, remarkably thin. There was not a single named source who could provide direct evidence of the practice. Nor were there any experts cited who could talk about the phenomenon. Statistics? We don’t need no stinking statistics. My students and I agreed that this was worth keeping an eye on.

Well, well, well. The New York Post reported over the weekend that Martin’s claims may not actually be true. Or as the Post puts it in its headline, “Upper East side housewife’s tell-all book is full of lies.” And though “wife bonuses” are not one of the “lies” exposed by the Post, its veracity appears to be on shaky ground. Here’s what Martin wrote in the Times on May 16:

Further probing revealed that the annual wife bonus was not an uncommon practice in this tribe.

And here’s what she told the Post:

I don’t necessarily think it’s a trend or widespread. It was just one of the many strange-seeming cultural practices that some women told me about.

Granted, not a full retreat. But Martin is clearly hedging.

Now it looks like “Primates of New York” is headed for the monkey cage. The Times today reports that the publisher, Simon & Schuster, will “append a note to future editions of the book, written by the social researcher Wednesday Martin, clarifying that some of the memoir’s details and chronologies were changed.”

We await public editor Margaret Sullivan’s take on the latest bogus trend story to find its way into the Times — something she has already joked about with her “Monocle Meter,” named after a trend story about young hipsters wearing monocles that appeared to be — well, uh, you know. Unsubstantiated.
