Boston Phoenix editor Carly Carioli catches the New York Times again — and talks it over with Times columnist Joe Nocera.
Last Saturday the New York Times posted a PDF of a 1976 article by the legendary Boston sports journalist Clark Booth that appeared in the Real Paper, an alternative weekly that was published for several years in the 1970s. The article accompanied a column by Joe Nocera on football injuries, about which Booth wrote perceptively some 36 years ago.
I have to confess I didn’t think twice about copyright, figuring Booth, whom Nocera interviewed, had given him permission to reproduce his words. But now Boston Phoenix editor Carly Carioli has pointed out — rightly, in my view — that, in fact, the Times has violated the Real Paper’s copyright and that of the photographer(s) whose work was reproduced. And since the Phoenix acquired the Real Paper’s assets when the paper went out of business, the Times must answer to the Phoenix.
The Times’ reproduction clearly fails the fair-use test, most obviously on the grounds that it reposted the Real Paper article not for the purpose of commentary and criticism, but so that its readers could enjoy reading it. I imagine the Times could also get whacked for taking too much of the article (i.e., the whole thing). Even though it would be tough to argue that anyone lost any money as a result of the Times’ actions, another important fair-use test, I’d guess a judge would favor the Phoenix if it ever came to that.
But Carioli is not concerned with the negligible harm the Times has done to the Phoenix so much as he is with the behemoth’s rank hypocrisy. Former executive editor Bill Keller, now a Times columnist, has been obsessed with the nefarious forces whom he believes have been improperly profiting from Times content. And, Carioli notes, the Times reached out and killed a pretty cool iPad app called Pulse merely because it reproduced headlines without permission.
Writing that “copyright in this country is a goddamn mess,” Carioli continues: “We want an internet and an intellectual-property regime that rewards discovery and innovation. We won’t get it with copyright construed the way it is now.”
And we won’t get it with the Times saying one thing and doing another.

In my latest for the Huffington Post, I take a look at the abuse heaped upon Washington Post ombudsman Patrick Pexton and New York Times public editor Arthur Brisbane. And though they clearly deserved to be criticized for their lazy, ill-considered commentaries, the over-the-top nature of the reaction says more about their critics than it does about them.
In case you missed it, Michael Calderone of the Huffington Post weighed in with a very interesting story Tuesday on turmoil at the New York Times Co. At the top of the list is the $15 million being paid to departing chief executive Janet Robinson, who by all appearances had a falling-out with company chairman Arthur Sulzberger.
No doubt you recall that the Times Co. demanded the Boston Globe’s unions agree to $20 million in givebacks in 2009 as the price of keeping the paper alive. Now Sulzberger has given 75 percent of that money to one person. Yeah, yeah, it’s a one-time expense versus annual savings from the unions, but you get the picture.
The Times Co. this week also followed through on its plan to sell its Regional Newspaper Group, 16 smaller dailies in the South and the West. Media business analyst Ken Doctor tells the Times that the sale price of $143 million was “incredibly low” (indeed: only 9.53 Robinson-size buyout packages), and that the deal buys company executives time to think about whether it wants to keep or sell the Globe.
Following a tumultuous 2008 and ’09, the Times Co. appeared to have achieved some stability, putting its financial house at least somewhat back in order. It looks like that stability may now be coming to an end.
You may have heard that Mitt Romney called Newt Gingrich “zany” in an interview with the New York Times — a rather incendiary charge that’s now burning its way through the political Web. A quick sampling:
And there’s plenty more where that came from. So would it surprise you to learn that claiming Romney called Gingrich “zany” is barely half-true?
In fact, this is a media-created controversy. The Times put the word in Romney’s mouth, and Romney, as maladroit a candidate as I’ve seen in my lifetime, repeated it. If this little incident backfires on Romney, he surely deserves some of the blame. But, anyway, let’s roll the tape. If you would like to watch, start at about the 3:00 mark. Times reporter Jeff Zeleny is asking Romney about Gingrich:
Zeleny: He has big ideas sometimes, and it seems that he is sort of rapid fire with his thought. Do you think that the American voters are getting enough of a sense of what he might do? Or is there some worry that as president, should he win, that there might be some zany things coming from the Oval Office?
Romney: Well, zany is not what we need in a president. Zany is great in a campaign. It’s great on talk radio, it’s great in the print. It makes for fun reading. But in terms of a president, we need a leader. And a leader needs to be someone who can bring Americans together. A leader needs to be someone of sobriety and stability.
So there you have it. Zeleny, not Romney, called Gingrich “zany,” and Romney went with the flow rather than disagree. If you keep watching, you’ll see Zeleny ask Romney whether he considers Gingrich “unstable,” a reference to Romney’s use of the word “stability.” Romney does not rise to the bait.
Despite what actually happened, the Times story, on which Zeleny takes the lead byline, begins like this:
Mitt Romney, his presidential aspirations suddenly endangered by Newt Gingrich’s rapid resurgence, is employing aggressive new arguments in an effort to disqualify Mr. Gingrich as a credible choice to Republicans, calling him “zany” in an interview on Wednesday and questioning his commitment to free enterprise.
Nor is there any further clarification deeper in the story. And it gets worse, as columnist Gail Collins says of Romney, “Zany really is a pretty unusual word. Why do you think he chose it?” Well, gee, Gail — he didn’t. You only write two columns a week. Would it be too much to ask that you at least watch the edited version of your own paper’s interview?
At this hour, there’s no way of knowing how the “zany” matter is going to play. Will Romney be characterized as looking strong or desperate? I don’t want to make excuses for Romney. He should have sensed danger, he failed to do so and now he may pay a price for it.
But he didn’t really call Gingrich “zany.”

The New York Times unveiled a new online commenting system today. Jeff Sonderman of Poynter and Chris O’Shea of FishbowlNY cover the changes pretty thoroughly — as does Chris Lefkow of Agence-France Presse, who interviewed me for his story.
The Times deserves a lot of credit for taking comments seriously enough to do a rethink. The centerpiece to its new policy is that “trusted commenters” — invitation-only contributors with a track record of being thoughtful and civil — will be able to post without pre-screening as long as they are willing to do so using their Facebook accounts.
Why does Facebook matter? Yes, it’s the social network that we all love to hate. But it also requires its users to provide their real names. And we’ve all become accustomed to behaving a certain way on Facebook.
We share our pictures, we wish each other a happy birthday, we send cheery messages to friends from high school whom we haven’t seen in years. All of this is the antithesis of the nutty, often racist comments that pollute many newspaper sites.
Comments matter. They can be a way for news organizations to establish a community and carry on a conversation with their audience. They haven’t worked out as we might have hoped 10 years ago. But that’s no reason not to keep trying.

At long last, I got to see “Page One: Inside the New York Times” at a screening last night at Harvard’s Shorenstein Center. It’s a terrifically entertaining look at the culture inside the Times newsroom, focusing on the media desk’s coverage of the newspaper meltdown of 2009 and ’10. I brought a couple of students with me, and they were pretty enthusiastic about it as we were driving back to Northeastern.
As you have no doubt heard, the stars are columnist David Carr and reporter Brian Stelter, two people whose talents, though formidable, pale in comparison to their inhuman productivity. Carr easily slips into the role of Carr, a late-middle-aged reformed drug addict who genially F-bombs his way through interviews and public appearances, building up to his monumental takedown of Tribune Co. and its abusive owner, Sam Zell. Stelter, young and earnest, is the perfect counterpoint. (I know both of them slightly, Carr better than Stelter.)
Director Andrew Rossi and Shorenstein Center director Alex Jones kicked it around afterwards.
An obsessive media junkie probably won’t learn much, but I really enjoyed being immersed in Timesland for 90 minutes. Quibbles? As a friend observed, the documentary was heavily tilted toward men, which seems odd given that before it ends, we see the executive editor’s baton being passed from Bill Keller to Jill Abramson.
And though it was unavoidable, the sense of panic that pervaded the business when the film was being shot has abated to at least some degree. We’re hardly out of the woods. It seems that every day, we hear about cost-cutting and layoffs. But the notion that was prevalent a year or two ago, that the entire newspaper business was in its death throes, now appears to have been exaggerated. If “Page One” were shot today, I suspect it would be more optimistic.
During the same week that the Boston Globe started charging for much of its online content and the New York Times announced it has signed up 324,000 paying digital customers, the Providence Journal unveiled its new website — a prelude to its long-promised (or long-threatened) paywall.
The new ProvidenceJournal.com — goodbye, Projo.com — includes just the first few paragraphs of most stories. If you want to read the whole paper online, you have to subscribe to one of those miserable e-editions, a PDF-like format that is difficult to navigate and even more difficult to read. (The Journal’s implementation does seem to be slightly less miserable than others I’ve seen.) There’s an iPad version, too.
Ted Nesi, who’s been writing about the Journal for WPRI.com, says it’s not yet clear what access will cost after the current free trial period expires. But this is not a digital strategy — it’s a print strategy, built on the idea of downgrading the Journal’s electronic presence. Nesi and I talked last December, when the Journal announced the new direction, and what I said then seems to apply now:
The Journal is sacrificing its website in order to bolster its print edition, which is where it makes most of its money. I understand why Journal managers are doing this, but it’s a short-term solution that could prove harmful in the long term. I also wonder whether it will even accomplish anything. Newspaper readers are skimmers, and a headline and brief synopsis of a story may be all that they want.
The Times is proving that people will pay for a well-thought-out, reasonably priced online edition. The Globe is about to learn whether readers in Greater Boston will do the same. The Journal, by contrast, is looking backwards. It might even work — but for no more than a few years.

There’s been a pretty interesting development in the battle over Robert Kennedy’s papers. The New York Times reports that members of Kennedy’s family are unhappy with the John F. Kennedy Library in Boston, and may move the papers to George Washington University.
The story also says the family decided on March 1 to release 63 boxes of papers, some of them “dealing with Cuba, Vietnam and civil rights, [that] are classified as secret or top secret.”
These would appear to be the “54 crates of records” that the Boston Globe revealed last January were being withheld from all but a few favored historians. At that time, Robert Kennedy’s son Max placed his foot firmly in his mouth, telling the Globe’s Bryan Bender that he’s all for openness except in those cases when he’s not.
“I do believe that historians and journalists must do their homework, and observe the correct procedures for seeking permission to consult the papers, and explain their projects,” Max Kennedy was quoted as saying. Max’s boffo performance led me to bestow a Boston Phoenix Muzzle Award upon him recently.
In the Times story, there is no mention of Max. Instead, another of Robert Kennedy’s sons, former congressman Joe Kennedy, emerges as the family spokesman, and he comes off as considerably more diplomatic than his younger brother.
A search of the Globe and Times archives shows that the family’s March 1 decision to release the papers was not reported prior to today’s Times story. That suggests a deliberate strategy of working hand in hand with Adam Clymer, the retired Times reporter who gets the lead byline today. Clymer, you may recall, is the author of “Edward M. Kennedy: A Biography,” a respected though admiring treatment of the late senator published in 2000.
