What does it mean to ‘publish’ in the age of Section 230? Plus, Olivia Nuzzi update, and media notes

What does it mean to “publish” something? In the pre-social media era, that question was easy enough to answer. It became a little more complicated in 1996, when Congress passed a law called Section 230, which protects internet providers from liability for any third-party content that might be posted on their sites.

But those early online publishers were newspapers and other news organizations as well as early online services such as CompuServe, AOL and Prodigy. None of them was trying to promote certain types of third-party content in order to drive up engagement and, thus, ad revenues.

Today, of course, that’s the whole point. Algorithms employed by social media companies such as Meta (Facebook, Instagram and Threads), Twitter and TikTok use sophisticated software that figures out what kind of content you are more likely to engage with with so they can show you more of it. Such practices have been linked to, among other things, genocide in Myanmar as well as depression and other mental health issues.

So again, what does it mean to “publish”? I’ve argued since as far back as 2017 that elevating some third-party content over others could be considered publication rather than simply acting as a passive receptacle of whatever stuff comes in over the digital transom.

A print publication, after all, is legally responsible for everything it encompasses, including ads (the landmark Times v. Sullivan libel decision involved an advertisement) and letters to the editor. It would be neither practical nor desirable to hold social media companies responsible for all third-party content. But again, if they are boosting some content to make it more visible because they (or, rather, their unblinking algorithms) think it will get them more engagement and make them more money, how is that not an act of publishing? Why should it be protected by federal law?

Earlier this week, investigative journalist Julia Angwin wrote an op-ed piece for The New York Times (gift link) arguing that the tide may be turning against the social media giants, in part because of TikTok’s aggressive use of its algorithmic “For You” feed, which has been emulated by the other platforms. A showdown over Section 230 may be headed for the Supreme Court. She writes:

If tech platforms are actively shaping our experiences, after all, maybe they should be held liable for creating experiences that damage our bodies, our children, our communities and our democracy….

My hope is that the erection of new legal guardrails would create incentives to build platforms that give control back to users. It could be a win-win: We get to decide what we see, and they get to limit their liability.

I don’t think there’s a good-faith argument to be made that reforming Section 230 would harm the First Amendment. We would still have the right to publish freely, subject to long-existing prohibitions against libel, incitement, serious breaches of national security and obscenity. And internet providers would still be held harmless for any content posted by their users. But it would end the legal absurdity that a tech platform can boost harmful content and then claim immunity because that content originated with someone else. (Ironically, those third-party posters are fully liable for their content if they can be identified and tracked down.)

As Angwin notes, Ethan Zuckerman of UMass Amherst, a respected thinker about all things digital, is suing Meta for the right to develop software that would allow users to control their own experience on Facebook. Angwin also touts Bluesky, a Twitter alternative that allows its users to design their own feeds (you can find me at @dankennedy-nu.bsky.social).

We should all have the right to freedom of speech and freedom of the press. But the platforms that control so much of our lives should should have the same freedoms that the rest of us have — and that should not include the freedom to boost harmful content without any legal consequences because of the fiction that they are not engaged in an act of publishing. It’s long past time to make some changes to Section 230.

Olivia Nuzzi departs

Olivia Nuzzi’s separation agreement with New York magazine was heavily lawyered, according to reports, and that shouldn’t come as a surprise to anyone. But the magazine’s statement that its law firm found “no inaccuracies nor evidence of bias” in her work needs to be placed in context. Liam Reilly and Hadas Gold of CNN report on Nuzzi’s departure.

Nuzzi, you may recall, was involved in some sort of sexual (but not physical) relationship with Robert F. Kennedy Jr. that may have encompassed sexting and nude selfies — we still don’t know.

But as I wrote last month, after Nuzzi’s relationship with Kennedy became public, she wrote a very tough piece about President Biden’s alleged age-related infirmities while Kennedy was still a presidential candidate and an oddly sympathetic profile of Donald Trump after Kennedy had left the race, endorsed Trump and made it clear that he was hoping for a high-level job in a Trump White House.

Maybe Nuzzi would have written those two stories exactly the same way even if she had never met Kennedy. But we’ll never know.

Media notes

• Billionaire ambitions. Benjamin Mullin of The New York Times reports (gift link) that a Florida billionaire named David Hoffmann has bought 5% of the cost-cutting Lee Enterprises newspaper chain, and that he hopes to help revive the local news business. “These local newspapers are really important to these communities,” Hoffman told Mullin. “With the digital age and technology, it’s changing rapidly. But I think there’s room for both, and we’d like to be a part of that.” Lee owns media properties in 73 U.S. markets, including well-known titles such as the St. Louis Post-Dispatch and The Buffalo News.

• Silent treatment. Patrick Soon-Shiong, whose ownership of the Los Angeles Times has been defined by vaulting ambitions and devastating cuts, has stumbled once again. Max Tani of Semafor reports that the Times will not endorse in this year’s presidential content, even though it published endorsements in state and local races just last week. The decision to abstain from choosing between Kamala Harris and Donald Trump, Tani writes, came straight from Soon-Shiong, who made his wealth in the health-care sector. Closer to home, The Boston Globe endorsed Harris earlier this week.

• Reaching young voters. Santa Cruz Local, a digital nonprofit, has announced an ambitious idea to engage with young people: news delivered by text messages and Instagram. “We want to reach thousands of students with civic news and help first time voters get to the ballot box,” writes Kara Meyberg Guzman, the Local’s co-founder and CEO. The Local’s Instagram-first election guide will be aimed at 18- to 29-year-olds in Santa Cruz County, with an emphasis on reaching local college students; Guzman is attempting to raise $10,000 in order to fund it. Santa Cruz Local was one of 205 local news organizations to receive a $100,000 grant from Press Forward last week. Guzman was also interviewed in the book that Ellen Clegg and I wrote, “What Works in Community News,” and on our podcast.

Of elephants, circuses and the Olivia Nuzzi-Robert F. Kennedy Jr. imbroglio

In the weeks after President Biden’s disastrous performance in the June 27 presidential debate, there were several crucial data points. His interviews with George Stephanopoulos and Lester Holt, which did little to restore confidence in his abilities to think and communicate clearly. A Wall Street Journal story on how his staff was stage-managing his decline. A New York Times op-ed by the actor George Clooney, a longtime Biden friend and supporter, urging the president to step aside.

So I don’t want to make too much of a story by Olivia Nuzzi, published in early July by New York magazine, which described Biden as increasingly out of it and obviously unfit to stay in the campaign. But I will tell you that it made an impression on me at the time, combining first-hand observation and quotes from people close to Biden. Yes, the quotes were anonymous, a fact that is now being added to the bill of particulars against Nuzzi. But haven’t we all gotten accustomed to that? Did anyone seriously expect Biden’s friends to step forward and attach their names to what they were saying — other than Clooney?

Here’s an excerpt from Nuzzi’s story that describes — rather compellingly, I think — the rising fears among Biden’s friends and supporters:

When they discussed what they knew, what they had heard, they literally whispered. They were scared and horrified. But they were also burdened. They needed to talk about it (though not on the record). They needed to know that they were not alone and not crazy. Things were bad, and they knew others must also know things were bad, and yet they would need to pretend, outwardly, that things were fine. The president was fine. The election would be fine. They would be fine. To admit otherwise would mean jeopardizing the future of the country and, well, nobody wanted to be responsible personally or socially for that.

Now we know that Nuzzi’s entire article was corrupt. That is, it’s suffused with a kind of wrongdoing that’s separate from fabulism or plagiarism, two species of journalistic ethics violations that we’re all familiar with. Nuzzi’s piece might be entirely accurate as well as truthful in its judgments and conclusions. But we don’t know. We’ll never know.

You probably have heard that Nuzzi was involved in some sort of sex scandal with Robert F. Kennedy Jr., who was, by turns, a Democratic and then an independent candidate for president before ending his ridiculous campaign and endorsing Trump. The details of the scandal aren’t important; they reportedly involve nude photos, maybe sexting. What matters is Nuzzi was writing that Biden was too infirm to stand for re-election while she was sexually involved with one of his rivals.

The story about Nuzzi and Kennedy was broken last Thursday by independent media reporter Oliver Darcy in his newsletter, Status. Darcy reported that Nuzzi had been placed on leave, and he published this statement from New York magazine:

Recently our Washington Correspondent Olivia Nuzzi acknowledged to the magazine’s editors that she had engaged in a personal relationship with a former subject relevant to the 2024 campaign while she was reporting on the campaign, a violation of the magazine’s standards around conflicts of interest and disclosures.

Had the magazine been aware of this relationship, she would not have continued to cover the presidential campaign. An internal review of her published work has found no inaccuracies nor evidence of bias. She is currently on leave from the magazine, and the magazine is conducting a more thorough third-party review. We regret this violation of our readers’ trust.

No evidence of bias? I just pointed out massive evidence of bias. You can’t report on one candidate when you’re sexually involved with another. Or as the late New York Times editor Abe Rosenthal once memorably put it: “I don’t care if you fuck the elephants, but if you do, you can’t cover the circus.” Much of what Nuzzi wrote about Biden was obvious to anyone who had watched Biden fumbling and stumbling on TV. But did she lay it on a little thick to help Kennedy? Did she make Biden seem more infirm than he really was? Or was she truly able to separate the personal from the professional? Who knows?

The last Nuzzi story I encountered was just a couple of weeks ago. It was a long interview with Trump that struck me as interesting, offering some insights into Trump’s thinking following the first assassination attempt, but weirdly soft and sympathetic. I didn’t think much of it at the time, but now we know that she was involved, or had been involved, with someone who was angling for a high position in a possible Trump administration. Again — no bias? Seriously? By the way, I listened to her Trump profile on The New York Times’ audio app, and I’m sure Times editors are thrilled to have learned that they provided Nuzzi with an additional platform she didn’t deserve.

Unlike some observers who’ve been piling on Nuzzi, I knew nothing about her until last week except that was young (31) and employed by a magazine that I thought had high standards. I remember with relish a story she wrote several years ago about traipsing through New York City with a clearly inebriated Rudy Giuliani. I knew she had a reputation for being extraordinarily talented.

One story of hers I have not read is her profile of Kennedy from last November, which is reportedly what led to whatever it was that came next.

On a personal level, what a mess. The oft-married Kennedy has been caught cheating (I guess?) on his wife, the actress Cheryl Hines, while Nuzzi was until recently engaged to Politico’s Ryan Lizza, who lost a previous job at The New Yorker over some MeToo allegations.

But you can get caught up on all the tabloid details elsewhere. What matters is that Nuzzi, one of our highest-profile political writers, wrote two long profiles this year that were so enmeshed in her undisclosed (at the time) conflict of interest that we now have no way of knowing whether they were on the level — or were instead hopelessly compromised.

Why Brian Williams may not be able to come back

Even though it’s an anonymous quote, the ending of this New York magazine piece on Brian Williams by Gabriel Sherman shows why it will be hard — maybe impossible — for him to return:

As one insider put it today: “The lingering questions in the executive suite is if he stays, how does he ever sit down with Rand Paul or Chris Christie and say, ‘You said this two years ago, and you said this last week.’ How does he do that?”

He doesn’t. He can’t.

Update: And he won’t. NBC has suspended Williams for six months without pay. Such a harsh punishment is almost certainly a preliminary step toward a negotiated departure.

Jill Abramson, accountability and The New York Times

My two favorite stories about Jill Abramson both speak to her insistence on holding The New York Times to account. Those stories may help explain why she was removed as executive editor on Wednesday.

The first pertains to investor Steven Rattner, a friend of publisher Arthur Sulzberger Jr. who was being investigated by the Securities and Exchange Commission over a kickback scheme involving the New York State pension fund. (In November 2010 Rattner paid a $6.2 million settlement and accepted a two-year ban on some of his trading activities.)

According to The New Yorker’s Ken Auletta, Abramson — then the managing editor, serving as Bill Keller’s number two — didn’t hesitate to green-light a front-page investigative report on Rattner, the Sulzberger connection be damned. “What better test is there for an editor than how they handle the publisher’s best friend?” Auletta quoted an unnamed Times source as saying.

To Sulzberger’s credit, the incident didn’t prevent him from naming Abramson to succeed Keller in 2011. But what may have created an irreparable breech was a second, similar story. In 2012, Sulzberger chose Mark Thompson, the former director general of the BBC, to become chief executive officer of the New York Times Co. Before Thompson could begin, Abramson dispatched one of the Times’ top investigative reporters to look into whether Thompson had any role in the child-sex-abuse scandal whirling around Jimmy Savile, a once-popular TV host.

Both Thompson and Sulzberger were angry, reports Gabriel Sherman in New York magazine. A source was quoted as saying of Sulzberger: “He was livid, in a very passive aggressive way. These were a set of headaches Jill had created for Arthur.”

Now the Times’ internal top cop is off the beat. And Thompson, presumably, has a freer hand to enact his agenda — an agenda that is said to include, among other things, more online video and more native advertising, the term of art used to describe what used to be disparagingly referred to as “advertorials.”

Abramson’s successor and former number two, Dean Baquet, is now the paper’s first African-American executive editor, a not-insignificant milestone on a par with Abramson’s being the first woman. He is said to be a fine editor and a popular choice with the newsroom.

But given that Sulzberger’s own son recently wrote a report arguing that the Times isn’t moving quickly enough on the digital front, it might seem strange that Abramson’s successor would be someone regarded as even less digitally savvy than she. The likely explanation is that Thompson sees himself as the paper’s chief digital officer. Certainly Thompson does not lack for confidence. Less than a year ago he supposedly told a Times executive, “I could be the editor of the New York Times,” according to an article by Joe Hagan in New York magazine.

I don’t mean to play down any of the other reasons that have been given for Abramson’s abrupt and brutal dismissal. There is the matter of her brusque demeanor, described in detail last year by Dylan Byers of Politico. At the time I dismissed it as anonymously sourced sexism, but Byers is deservedly taking a victory lap this week.

Another factor was her complaints about making less money than Bill Keller did when he was editor, a story Ken Auletta broke within hours of Abramson’s dismissal. Auletta reported that Abramson even learned she made less than a male deputy managing editor when she was managing editor. The Times has denied all, although in language that makes it hard to figure out what, precisely, it is denying.

And then there is the incident that may have precipitated the final crisis — her reported attempts to hire Janine Gibson away from The Guardian to serve as a co-managing editor for digital without bothering to inform Baquet. Certainly that’s the angle that the Times’ David Carr and Ravi Somaiya play up in their own coverage of Abramson’s dismissal. (Other accounts say Gibson would have been a deputy managing editor, and thus presumably less of a threat to Baquet’s authority.)

Still, none of these reasons sufficiently explains why Sulzberger believed Abramson needed to be dealt with so harshly. She was all but hustled out of the building, treated like Howell Raines after he was dismissed for enabling a plagiarizing, fabricating young journalist named Jayson Blair. By contrast, the Times under Abramson’s editorship has been a journalistic success and has done reasonably well financially at a time when the news business has been imploding, as Matthew Yglesias explains at Vox. (Vox also takes the prize for the best Abramson headline: “Tattooed, puppy-stealing badass editor Jill Abramson out at the New York Times.”)

“I think what it says to us is there is still enormous challenges for women out there, for women who assume those key and influential roles in journalism,” Melissa Ludtke, a pioneering sports journalist and former editor of Nieman Reports, told Politico’s Anna Palmer.

I think it’s more complicated than that. It is nevertheless a fact that in the past few years Sulzberger has fired two of the highest-ranking women in the newspaper business — first Janet Robinson, creating the vacancy that Mark Thompson later filled, and now Abramson.

In addressing the staff Wednesday, Sulzberger referred to “an issue with management in the newsroom.” That’s not good enough. And it’s not the kind of accountability Abramson pushed for in covering the powerful institution that she worked for. I hope we’ll learn more in the days ahead.

Say it ain’t so, Frank Rich

When you get to my age, you look for your thrills where you can find them. Come Saturday night, I usually find myself asking … Should I read Frank Rich now, or save it until the morning?

So I was shocked to learn this morning that Rich, one of our leading liberal commentators, is leaving the New York Times for New York Magazine, where he’ll write a monthly essay. He’ll edit and lead some online conversations as well.

It’s not the first time Rich has grown restless. He was the Times’ chief drama critic from 1980 to 1993, and I think it’s his theatrical sense that makes his political commentary so sharp and entertaining.

This is not good news for me, and I’m sure many other Times readers feel the same way. New York Magazine has a good reputation, but I can’t picture myself subscribing or seeking it out online. Other than the occasional must-read media feature, it just isn’t compelling enough for me to change longstanding habits.

In 2000 I ran into Rich at an event for gay Republicans at the Republican National Convention in Philadelphia, which I was covering for the Boston Phoenix. I asked him about the collective nervous breakdown the media were having over the lack of news at George W. Bush’s coronation. Here’s what he told me:

Not to be too Freudian about it, but what you’re seeing is a sort of displacement. There are 15,000 reporters here and no story. What are they going to talk about? Themselves and their own anxiety.

It will be interesting to see whether the Times tries to recruit a big-name replacement for Rich. (Maybe it will be Joe Nocera, who’s moving from the business pages to the op-ed section.) With the exception of Paul Krugman and David Brooks, I just don’t find the rest of the paper’s opinion writers all that compelling.

Rich had one of the best jobs in journalism. I guess it shows that anything can get boring after a while.
