Yes, Trump officials spied on reporters. But every president abuses the press.

The revelation last week that the Trump Justice Department had spied on three Washington Post reporters’ phone records barely caused a stir. But as much as I’d like to think that such behavior would shock the conscience, I can understand why the story failed to resonate. It was, after all, the sort of thing that all administrations do. To invoke a pandemic cliché, it was a sign that nature is healing.

Not to sound cynical and world-weary. We should be outraged. We should be shouting from the rooftops. When the government uses its awesome legal powers to stymie journalists who are trying to do their jobs, we lose our ability to hold the powerful to account. The incident would stand as yet another example of former President Donald Trump’s authoritarian tendencies — except that, at least in this instance, his actions were right in line with those of his predecessors.

As Jon Allsop of the Columbia Journalism Review wrote, “it’s not ‘bothsidesism’ to call out loathsome things that both sides are actually doing.”

So what happened? Devlin Barrett of the Post reported last Friday night that the Justice Department informed current Post journalists Ellen Nakashima and Greg Miller and former Post journalist Adam Entous that their phone records had been obtained, and their email logs had been unsuccessfully sought, for mid-April through July of 2017. The phone records showed whom the reporters were in contact with but did not reveal the contents of the calls.

There are a few details that make this particular exercise of executive power especially disturbing. The three reporters were delving into the 2016 Trump campaign’s ties to Russia during the period in question. The records were sought in 2020, when the attorney general was Trump enabler William Barr. Thus the incident could be seen as part of Trump’s long-standing obsession with covering up his ties to Russian interests.

In other respects, though, it was business as usual.

I wrote a commentary in 2012 for HuffPost headlined “Obama’s War on Journalism.” It’s a matter of public record that Barack Obama, during his eight-year presidency, showed a shocking lack of regard for the role of the press in a free society. Obama and his attorney general, Eric Holder, were obsessed with identifying government officials who had leaked sensitive or embarrassing information to the press. One reporter, James Risen of The New York Times, was threatened with jail for several years.

The Obama years were extreme but not exceptional. Previously, then-Times reporter Judith Miller actually did a stint behind bars for refusing to cooperate with an independent counsel’s investigation into possible wrongdoing by officials in George W. Bush’s administration: Someone had publicly identified a CIA operative in apparent retaliation for an op-ed (oops, guest essay) her husband had written for the Times that accused officials of ignoring evidence contradicting their claim that Iraq was trying to build nuclear weapons.

At least in that case, Bush had nothing to do with the investigation that landed Miller in jail. But Bush hardly had clean hands. After the Times reported that Bush’s National Security Agency was illegally spying on Americans, Bush denounced the paper’s work as “a shameful act,” and people around him urged that the Times be prosecuted under the World War I-era Espionage Act. The Times won a Pulitzer Prize for its revelations.

Of course, Richard Nixon’s attempts to retaliate against the press were legendary, ranging from including hostile reporters on his “enemies list” to threatening to strip The Washington Post of its television stations.

A central dilemma in all of these cases is that though the First Amendment offers robust protections for anything that the media might publish or broadcast, it is relatively silent on protections for reporting. In Branzburg v. Hayes, the 1972 decision that reporters do not have a constitutional right to protect their anonymous sources, Justice Byron White wrote that “news gathering is not without its First Amendment protections.” As a general rule, though, reporters have no more protections in going about their jobs than do ordinary members of the public.

Will the situation improve under President Biden? Not likely. As the CJR’s Allsop pointed out, the Biden Justice Department didn’t just inform the three Post journalists that they had been spied upon — it went out of its way to endorse the practice. Marc Raimondi, a spokesman for the current Justice Department, was quoted in the Post’s account as saying that the department “follows the established procedures within its media guidelines policy when seeking legal process to obtain telephone toll records and non-content email records from media members as part of a criminal investigation into unauthorized disclosure of classified information.”

Raimondi added — shades of Obama and Holder — that “the targets of these investigations are not the news media recipients but rather those with access to the national defense information who provided it to the media and thus failed to protect it as lawfully required.”

With public approval for the media near record lows, and with the courts unlikely to carve out any new protections for journalism, it’s not realistic to think that things are going to change for the better any time soon.

At the very least, though, the president could issue guidance to his Justice Department, backed up with a strong public statement, that the government will not spy on, subpoena or prosecute journalists except under the most dire life-and-death circumstances.

Biden appears to be intent on breaking with his predecessors in many ways, especially regarding the size and scope of government. Respecting the role of the press would be one way that he could ensure greater scrutiny of that government on behalf of all of us.

The Washington Post chooses its first female executive editor

The Washington Post has a new executive editor — Sally Buzbee, currently the executive editor and senior vice president at The Associated Press. Of note: Post owner Jeff Bezos got involved in making the choice, and Paul Farhi writes that Buzbee was chosen at least in part because of her international experience.

Bezos and the Post’s top executives see world coverage as the next step in their competition with The New York Times, recently setting up news hubs in London and Seoul, South Korea, in order to give the paper 24-hour coverage.

Buzbee is the Post’s first female executive editor. Here’s the first question that springs to my mind: The AP is well-known as our most buttoned-down straight-news organization. The Post’s recently retired editor, Marty Baron, succeeded in straddling those old-school values with newer forms of journalism characterized by voice, attitude and “swagger,” to use a word that Bezos himself likes. Will Buzbee be able to adapt?

Why the Kevin Merida announcement is good news for the Los Angeles Times

Patrick Soon-Shiong may be the most important newspaper owner in the country after Jeff Bezos of The Washington Post. So Monday’s announcement that the next executive editor of the Los Angeles Times will be Kevin Merida of ESPN was significant as much for what it says about Soon-Shiong’s commitment to the paper as it does about Merida’s own considerable abilities. Given the Times’ size, influence and unrealized potential, its fate is crucial to the journalistic ecosystem.

It was just a few months ago that Lukas I. Alpert of The Wall Street Journal dropped a bombshell: Soon-Shiong, a billionaire surgeon who bought the Times in 2018, was looking to get out. Soon-Shiong denied it, but actions speak louder than words — and now he has acted. The fact that he could recruit someone who is regarded as the best free-agent editor out there suggests he was able to reassure Merida about stability in the owner’s suite. The Times itself, in a story by Meg James, puts it this way:

His hiring reaffirms the Soon-Shiong family’s commitment to the paper they purchased, along with the San Diego Union-Tribune, for $500 million from Chicago-based Tribune Publishing in June 2018. The Soon-Shiong family has since invested hundreds of millions of dollars more to replenish the newsroom’s withered ranks, built a campus in El Segundo, upgraded the paper’s technology and covered financial losses that deepened last year when coronavirus shutdowns prompted a steep drop in advertising revenue.

Key to all this may be Soon-Shiong’s daughter, Nika Soon-Shiong, who, according to Katie Robertson’s report in The New York Times, “has become an active part of the newspaper’s management team.” In that regard, she may play a similar role to that of Linda Pizzuti Henry, who co-owns The Boston Globe along with her husband, John Henry. Linda Henry, named CEO of Boston Globe Media last year, is heavily involved in the day-to-day operations of the Globe, thus serving as a guarantor of sorts that Henry won’t sell.

Merida will be the LA Times’ second Black editor, which is also significant because of the paper’s diversity issues under former executive editor Norman Pearlstine. It also raises the question of why The Washington Post didn’t push harder to hire Merida as a replacement for Marty Baron, who retired recently. Merida was a highly regarded top editor at the Post before leaving for ESPN.

One possible explanation is that Merida is just two years younger than Baron. As Tom Jones of Poynter writes, “Maybe the Post is looking for a long-term editor — someone who could take over for 15 or so years, and, perhaps, Merida’s age (64) didn’t align with that plan.”

The Soon-Shiong ownership of the LA Times has been a mixed bag thus far. The newsroom has been bulked up in the hopes that the paper could emerge as a national force. But that hasn’t happened, and its digital subscription numbers have proved disappointing as well. It could be that there’s just no room for a fourth national newspaper along with The New York Times, the Post and the Journal. But the LA Times could dominate the West, serving as a much-needed counterbalance to the East Coast media.

All in all, the appointment of Merida was very good news, not just because he’s a first-rate choice but because it signals that Soon-Shiong is committed to the LA Times’ long-range future.

Correction. The original post described Merida as the LA Times first Black editor. In fact, he is the second; New York Times executive editor Dean Baquet served in that role from 2005 to ’06.

A Washington Post correction adds to confusion over Rudy Giuliani and the FBI

When you have to publish a correction, be forthcoming about it. The Washington Post failed to do that over the weekend, thus compounding the harm it had done to Donald Trump adviser Rudy Giuliani. Here is the Post’s correction, published on Saturday:

An earlier version of this story, published Thursday, incorrectly reported that One America News was warned by the FBI that it was the target of a Russian influence operation. That version also said the FBI had provided a similar warning to Rudolph W. Giuliani, which he has since disputed. This version has been corrected to remove assertions that OAN and Giuliani received the warnings.

The correction makes it appear that the Post was backing down solely on Giuliani’s say-so. That led to a tweet from Caroline Orr Bueno in which she asked: “Why retract it instead of just adding in a statement saying Giuliani disputes it?” To which I responded: “Marty Baron has left the building,” referring to the recent retirement of the Post’s executive editor.

But it turned out not to be so simple. Because The New York Times and NBC News had also run stories claiming that Giuliani had been warned, and they published corrections as well. Tom Jones of Poynter rounds them up. First, the Times:

An earlier version of this article misstated whether Rudolph W. Giuliani received a formal warning from the F.B.I. about Russian disinformation. Mr. Giuliani did not receive such a so-called defensive briefing.

Not much explanation there, but at least the Times isn’t attributing the reason for its correction to Giuliani. The clearest is from NBC News:

An earlier version of this article included an incorrect report that Rudolph Giuliani had received a defensive briefing from the FBI in 2019 warning him that he was being targeted by a Russian influence operation. The report was based on a source familiar with the matter, but a second source now says the briefing was only prepared for Giuliani and not delivered to him, in part over concerns it might complicate the criminal investigation of Giuliani. As a result, the premise and headline of the article below have been changed to reflect the corrected information.

That’s how you do a correction: explain exactly went wrong. Of the three, the Post’s is the worst, since the wording makes it appear as though the editors were responding solely to a complaint by Giuliani. The Times’ is OK, but its lack of clarity and falls into the “mistakes were made” category. So kudos to NBC News for doing it the right way.

Giuliani remains in a heap of trouble. His apartment and office were searched by the FBI last week as part of what appears to be a criminal investigation into his activities in Ukraine. There was no need for news organizations to pump it up with information that was unverified and, as it turns out, wrong.

And, as Oliver Darcy of CNN observes: “All the original reports were attributed to anonymous sources.”

Has Biden’s press really been more negative than positive?

The Pew Research Center has released a massive study of how the media have covered the early days of the Biden administration. I am not going to do a deep dive, but I did find a few of the key findings interesting.

First, the study found that coverage was slightly more negative than positive (32% to 23%) — but that, in a separate survey of about 12,000 adults, about 46% thought the coverage had been mostly positive and only 14% assessed it as mostly negative. Here’s how the report put it: “Americans’ sense of the early coverage about the Biden administration tends to be more positive than the tone of the content that was studied.”

There was also a marked difference in coverage between media outlets with predominantly left- and right-leaning audiences as well as among the respondents themselves based on what media they consume. Pew chose 25 news organizations to study. Vox had the most left-leaning audience whereas Sean Hannity’s radio show had the most right-leaning.

My own sense is that coverage of President Biden and his administration has, in fact, been mainly positive, and that the perception of the survey respondents is closer to the mark than Pew’s assessment of the actual coverage. And I’d suggest that Pew reconsider its list.

Every Pew-chosen outlet appealing to left-leaning audiences is either a mainstream news organization or combines reporting with opinion. On the other hand, several of the outlets selected for study that appeal to right-leaning audiences consist of pure opinion that’s often combined with misinformation — among them Fox News, Breitbart, Newsmax and Hannity’s and Mark Levin’s radio shows.

The other finding that struck me was that most stories about Biden have focused on “his ideology and policy agenda,” whereas, four years earlier, stories about the early days of Donald Trump’s presidency centered on “his character and leadership.”

Needless to say, that’s far more a reflection of the two presidents than of the media. Biden represents a return to normality, and news organizations obviously are going to spend much of their time covering a normal new president’s beliefs and policy proposals. Trump’s entire presidency was about nothing but the cult of personality he encouraged — the consequences of which will be with us for some time to come.

Who’s that on the phone? A hilarious story about a New York Times reporter

In case you missed it, Spencer Buell of Boston magazine has a hilarious story about Zolan Kanno-Youngs, a reporter for The New York Times who covers the White House. It seems that his phone number is almost identical to that of Roller World in Saugus, and for at least 10 years Kanno-Youngs has been fielding calls meant for the rink. Kanno-Youngs tells Buell:

There have been times where I’m on deadline, or I’m on the verge of a good story. And I’m like, “Oh, here it is. Here’s the source that I’ve been wanting to call me.” And I’ll pick up and it’s like, “Hey, so Saturday at 9 a.m. you guys still going?” And I’m like, “What’s going on?” And then they’re like, “Yeah, you know, my birthday party!” And I’m like, “Oh my God, not right now!”

Of course I should mention that Kanno-Youngs is a Northeastern journalism alum. I hadn’t heard him tell this story before. I assume he’s now going to have to change his phone number — Buell doesn’t tell us what it is, but it’s easy enough to figure out.

A resignation provides some rare insight into the Murdoch media’s smear campaigns

Vice President Kamala Harris made history Wednesday night just by sitting behind President Biden during his joint address to Congress. As the understudy to our oldest president, Harris may well be the Democratic presidential nominee in 2024 if Biden decides not to seek re-election.

And Harris, who is not just the first female vice president but also the first Black person and Asian American to fill that role, is driving the right crazy. Back in 2019, when she was running her own presidential campaign, the main critique of her was that she was too conventional and too close to law enforcement. Now the right-wing media echo chamber portrays her as the fifth member of the Squad.

The latest attack on Harris backfired in an unusually spectacular manner, and illustrates the corrosive effect that the Murdoch media are having in this country.

On Saturday, Murdoch’s New York Post devoted its cover story to a report that immigrant children at the border were being given goodie bags that included taxpayer-purchased copies of Harris’ children’s book, “Superheroes Are Everywhere.”

The story immediately became fodder for Murdoch’s Fox News Channel. But the only evidence was a photo of one copy of the book, and the tale quickly unraveled — though that didn’t stop the Post, in a follow-up, from claiming that “thousands” of copies were distributed.

Then, on Tuesday, we received a rare moment of clarity. Laura Italiano, the Post reporter who wrote the story, tweeted that she had resigned. “The Kamala Harris story — an incorrect story I was ordered to write and which I failed to push back hard enough against — was my breaking point,” she wrote. Michael Grynbaum of The New York Times has all the details.

Now, if you’re thinking what I’m thinking, then you’re thinking that this happens all the time. One part of the Murdoch media empire runs with something false, exaggerated or, at the very least, unverified; other parts of the empire amplify it; and we have a full-blown fake scandal about Democrats on our hands. (Note: The Post has denied Italiano’s accusation. See below.)

Last fall, for instance, in what was surely the lamest attempt at an October surprise ever, Rudy Giuliani and Steve Bannon attempted to feed a story about Hunter Biden’s laptop to Fox News. Taking the sensible position that the story couldn’t be verified, Fox’s news division actually passed on it — only to see it pop up in the New York Post.

But not before some internal hand-wringing, as the Times’ Katie Robertson reported. The Post reporter who wrote most of the story refused to let his byline be put on it since he was afraid it would blow up, and several others declined as well. But Fox News, whose journalists had enough scruples not to take the story, recycled it endlessly on its opinionated talk shows, running “nearly 25 and a half hours, which included 420 segments” between Oct. 14 and 23, according to Rob Savillo of the liberal media-watch organization Media Matters for America.

Today the laptop story exists in kind of a weird limbo, neither proven nor disproven, and in any case telling us nothing of relevance about President Biden.

After stumbling a bit after Election Day and allowing pure Trumpist outlets like Newsmax and OANN to move in on its territory, Fox News has resumed its dominance, according to Ted Johnson of Deadline — although the three major cable news channels, Fox, CNN and MSNBC, are on the decline.

Morever, Fox, fed by the New York Post, remains the most dominant force in Republican politics, making it impossible for the party to move beyond Trump or even to think about compromising with Biden.

Former Australian prime minister Malcolm Turnbull recently testified before his country’s parliament about the harm his fellow Australian Murdoch has done. Among other things, he said:

What does Vladimir Putin want to do with his operations in America? He wants to divide America and turn Americans against each other. That is exactly what Murdoch has done: Divided Americans against each other and so undermined their faith in political institutions that a mob of thousands of people, many of them armed, stormed the Capitol.

On Thursday we learned that Giuliani’s home and office were raided by the FBI, reportedly in connection with his murky dealings in Ukraine as he attempted to draw a connection between alleged corruption by Hunter Biden and his father. Bannon has faced criminal charges since last August over an alleged fundraising scheme involving Trump’s wall at the southern border.

The Murdoch media, though, just goes on and on, smearing without truth or consequences. You’ll be hearing false stories about Kamala Harris’ book for the rest of her political career. Mission accomplished.

Update: The Post has denied Italiano’s accusation. The Times’ Grynbaum tweets:

By dropping the phrase ‘op-ed,’ The New York Times strikes a blow for clarity

Putting together the first New York Times op-ed page

I’m all in favor of getting rid of jargon that separates journalists from the public. A few years ago I stopped spelling “lead” as “lede,” and I explain to my students that it was a conscious decision rather than a sign that I’d just fallen off the turnip truck. (Some background from Willamette Week. About leads, not turnips.)

So I was intrigued that The New York Times has decided to use “guest essays” to describe what we’ve come to know as op-ed pieces. Times opinion editor Kathleen Kingsbury (and by the way, her title is itself a move away from the archaic: the person holding her job used to be called the “editorial page editor”) explains it this way:

Terms like “Op-Ed” are, by their nature, clubby newspaper jargon; we are striving to be far more inclusive in explaining how and why we do our work. In an era of distrust in the media and confusion over what journalism is, I believe institutions — even ones with a lot of esteemed traditions — better serve their audiences with direct, clear language. We don’t like jargon in our articles; we don’t want it above them, either.

A bit of history: The Times’ op-ed page is only 50 years old, and it literally means “opposite the editorial page.” With print becoming less and less relevant, the term “op-ed” wasn’t just jargony; it was nonsensical as well. The original idea was to expand the editorial page, with its unsigned editorials, cartoons (but not in the Times!), letters and staff-written opinion columns, by adding a second page devoted to contributions from community leaders, elected officials and the like.

Of course, it also led to the hiring of more staff columnists. But the basic idea survived, and calling something a “guest essay” is clear in a way that “op-ed piece” never was. And yes, someone has written a history of the Times’ op-ed page: University of Maine journalism professor Michael Socolow, whose work was summarized by Jack Shafer, then of Slate, in 2010.

Not long after the Times added its op-ed page, many other daily papers followed suit. It will be interesting to see whether any of them similarly follow the Times’ lead in renaming op-eds. (The Boston Globe doesn’t seem to have a label for outside contributions other than the same generic “opinion” that it also slaps on staff-written columns.)

I’m sure many of us will continue to use “op-ed” for a long time to come. But kudos to Kingsbury and the Times for this sensible step.

Update: Socolow has written an elegy to the op-ed page for Reason, lamenting that the original vision for provocative outside commentary has degenerated into groupthink. “Publishing offensive commentary these days is not simply seen as inflammatory in the old sense; many people consider it intentionally malicious, if not felonious,” he writes. “Any denial to the contrary — any defense of the old-fashioned marketplace of ideas, or calls for widening diversity of opinion — is widely viewed as little more than disingenuous subterfuge.”

Would you like some extra meat in your beer?

I doubt former Trump economic adviser Larry Kudlow knew what he was talking about when he suggested that beer is made out of meat. “You can throw back a plant-based beer with your grilled Brussels sprouts and wave your American flag,” Kudlow sneered on the Fox Business Channel. “Call it July 4th Green.”

Kudlow’s falsehood-filled claims that President Biden is targeting meat were lampooned this morning by New York Times columnist Paul Krugman. In fact, though, there is at least some basis for Kudlow’s take on beermaking, if not for his critique of Biden’s climate plans. Here’s what Wikipedia has to say:

Beer is often made from barley malt, water, hops and yeast and so is often suitable for vegans and vegetarians. Some beer brewers add finings to clarify the beer when racking into a barrel. Finings can include plant-derived products, like Irish moss, or animal-derived products, like isinglass and gelatin.

Most breweries do not reveal if they do or do not use animal products in the processing of their beers; some exceptions are Samuel Smith, Heineken, Harp Lager, Anheuser-Busch, the Marble Brewery in Manchester, the Black Isle Brewery, and Black Sheep Brewery, all of whom have declared they make vegetarian and/or vegan beer.

Isinglass, by the way, is “a substance obtained from the dried swim bladders of fish.” Yum!

In addition, Dr. Google turns up all kinds of articles about beer that uses meat. So even though Krugman is generally right in asserting that there is no meat in beer, there are some exceptions. Kudlow was not entirely wrong.

 

Why the golden age of podcasts may be coming to an end

You might look at it as the arrival of podcasts as a big business. My fear about what it really means is that the golden age of podcasts is coming to an end.

Anne Steele of The Wall Street Journal (one of our great Northeastern journalism graduates, by the way) reports on the looming podcast war between Apple, Spotify and a few smaller players. It sounds like it’s going to be just like video streaming services — if you subscribe to Spotify, as I do, you won’t be able to listen to podcasts that are exclusively on Apple, and vice-versa.

Steele quotes a business analyst named Daniel Ives as saying this about Apple:

Even though they have the keys to the kingdom in terms of overall customer base and the App Store and broader content, what’s going to differentiate them is not just aggregation, it’s exclusive content.

Just what we need — another walled garden. And look, I’m glad that this will enable podcasters to make some money beyond the ad revenue they get from the likes of MailChimp and Dollar Shave. But it also represents the end of something special — just as the rise of paywalls about a dozen years ago ended the open web.
