A brewing media battle in Newton

A potential battle is shaping up over the Boston Globe’s plans to start a hyperlocal Newton site on Boston.com that could feature, among other things, content from the weekly Newton Tab.

“This is just the latest move from the 800-pound gorilla in the market, which is currently weighing in at 200 pounds,” GateHouse Media New England publisher Kirk Davis tells Amy Derjue at Boston Daily. GateHouse, a national chain based in suburban Rochester, N.Y., owns about 100 newspapers in Eastern Massachusetts, including the Tab.

Davis adds: “We’re not surprised the Globe would like to play in our sandbox.”

Although it’s not entirely clear what the Globe’s got planned for Newton, a report by Chuck Tanowitz suggests that the paper will display headlines and summaries from Newton blogs and from the Tab.

It’s possible that the Globe will make everyone a winner by driving traffic to those sites. But it’s also possible that, for some stories, the headline and summary is all most people are looking for, which means they’ll stay at Boston.com. The stakes are high: both the Globe and GateHouse are trying to sell advertising on their local Web sites.

Depending on how the Globe proceeds, it could find itself facing copyright-infringement issues on two grounds:

  • GateHouse publishes its online content under a Creative Commons license, which allows other Web sites to republish stories as they see fit — a boon to bloggers. But GateHouse’s license specifically prohibits commercial use, which would seem to rule out the Globe.
  • Copyright law allows anyone to publish small snippets of someone’s content under the doctrine of fair use. A good example of that would be Google News. But the Globe might find itself challenged on the grounds that though it’s only taking a little bit, it’s nevertheless taking the most important and marketable part.

When I wrote about this over the weekend, GateHouse’s director of digital publishing, Howard Owens, posted a comment in which he said, “I think we need to have a little chat with Bob Kempf.” Kempf, now a top executive with Boston.com, was a key player in developing GateHouse’s Wicked Local sites.

While the GateHouse folks appear to be gearing up for battle, we haven’t heard much from Boston.com. On Sunday the Globe’s regional editor, David Dahl, sent an e-mail to let me know the Globe would be making an official announcement later this week. I told him I’d welcome comments from him and other Globe executives. So far, though, they’re maintaining their silence.

For those of us who care about local journalism, it’s painful to watch two financially challenged giants battling over a shrinking advertising base. On Monday the Globe’s parent company, the New York Times Co., reported that the value of its New England holdings continues to plummet. GateHouse was recently delisted by the New York Stock Exchange, although its revenues appear to be holding up reasonably well.

It’s possible that once the Globe announces its plans, we’ll see that this is much ado about nothing. But this bears watching.

Where does Rupert get his ideas?

After Alan Taylor launched “The Big Picture” on the Boston Globe’s Boston.com site earlier this year, he told an interviewer, “I know it’s totally copy-able.”

No kidding. Last week, the Wall Street Journal — not exactly known for its photojournalism — started a photo blog that was, well, identical to what Boston.com has been doing: a blog featuring huge photos of stories in the news and off the news.

The Journal even took the same name, “The Big Picture.” If you go there now, you’ll see that it’s been changed to “Photo Journal.” But I found last week’s version in Google’s cache, and I’ve reproduced it above. And “thebigpicture” remains part of the URL.

It’s a terrific concept: huge photos, mostly from the wires, of the sort that you’re bombarded with every day, but that you probably don’t really notice because they’re too small. “The Big Picture” invites you to look. As Melanie Lidman wrote in the American Journalism Review, “What sets his blog apart is its simplicity. Taylor lets the photos speak for themselves, one at a time, encouraging the viewer to scroll slowly down the page to take in the images.”

The Journal’s act blog thievery did not go unnoticed. Check out some of the comments, which, to the Journal’s credit, have been left intact:

I think it’s sad that a major news outlet like the WSJ lacks the creativity to come up with a blog name that isn’t already in use by another newspaper.

Agreed. If you’re going to lift someone else’s concept the least you can do is come up with an original name for it.

You couldn’t even change the name slightly? How about, “The Large Picture”? A hella-wicked ripoff, I tell ya! LOL!

“The Big Picture” is a great idea, and there’s no reason other news organizations can’t copy it. But for the Journal to steal the entire concept, right down to its name, without so much as a hat tip to the Globe and no original features of its own, seems like a bit much.

At least someone read the comments and changed the name.

James Pindell is moving on

Boston.com political blogger James Pindell is leaving to take a job as national managing editor of something called Politicker.com. Here’s the announcement.

Pindell writes the Primary Source blog for Boston.com. Some of his stories appear in the Boston Globe as well. Keep an eye on him: He’s one of the more interesting young people working in Web-based journalism today, having covered the New Hampshire primary in 2004 as editor of the late, lamented PoliticsNH.com.

As I tell my students, this may be a lousy time to pursue a traditional career path in journalism, but it’s a great time if you’re willing to be entrepreneurial and embrace new ways of doing things. Pindell gets new media in a way that most journalists don’t, making himself accessible by e-mail and AIM, and building a community around his work via Facebook.

His work for Boston.com and the Globe may be of interest mainly to political junkies. But because of his vision about where journalism is going, this is a big loss to the Globe.
